Is it legal for an elected official to give gifts to city employees during a re-election bid?

A sitting councilman is a current candidate for mayor. Gifts were placed at city employee work stations with a note to remember him and his candidate of choice for an open seat on the council on election day. The gifts were delivered after regular work hours at a city facility. Is this legal and how do community members report the activity to the election committee or should we waste our time reporting the activity . The election is November 6.

This doesn't sound legal and I bet you better contact the City Manager to advise that this practice is very wrong or at the very least not a good idea.

Reply:While you may not like or agree with his actions, they are perfectly legal, provided the gifts were not paid for with city funds and were given after normal operating hours. Reporting this will do nothing except make you look bad in the eyes of the city council. Judging from your message I would guess you probably work for the city, so reporting this could possibly cost you your job.

You're going to have to spend a "little" money for anything, but get some mason jars and get a good cookie recipe and layer the ingredients in the jar, add a decorative tag with the directions, add a decorative top and some ribbon, and voila. I saw the recipe on-line, search under "homemade gifts". Everyone Loves these.

Reply:In real life nothing is entirely free, because they generally require a bit of ribbon, or some glue or glitter... but there are some darn cheap ones:





The only completely free things to make are things made of natural supplies, like twig wreath ornaments. They can be very beautiful if you find the right twigs, with buds or small cones. Doogwood, alder pussywillow will bloom if brought indoors, and if you include a small cup at the base of the twigs to hold water. Budding heart shaped indoor wreaths are pretty special, you can't buy them because they have to be made almost immediately before hanging, and kept refrigerated while making (like doing it outdoors). Ornaments made of painted shells require a sharp knife to scratch the hole for hanging, a bit of wire and some paint, so if you don't have those things it is not free. Pine cones with some white granular substance like salt glued to the tips is pretty. These things depend on being in the right place to gather those things, and not everybody is in the right place.





Salt dough crafts are nearly free. You need salt, flour, water and and oven. Colors and textures can be got with all sorts of extra stuff, even dirt or sand. Having some walpaper paste or elmers glue makes a nicer texture in the dough. Here is a site that has a good recipe with descriptions of what to do to fix your dough if it is weird. Hint on this stuff: get the dough as thick and smooth as you can to avoid cracking in the oven.

You can try contacting the United Way or local churches. Toys for Tots just collects the toys and they have them out, they don't let you do it. You could also contact an orphanage or children's hospital and ask if there is a group already helping them at Christmas; if so, get the contact info and join them, if not, why not organize something yourself? Good for you for wanting to make a difference!
Reply:What a wonderful idea! As your local Children's Hospice if they will allow you to do that. Or an orphange that you know of. The way I started out was simply with a Box of Stickers and their email address! Now I've been going strong for 4 years now donating toys, books, games, puzzles, etc. to the children at a Hospice in England.


While I can't physically be there to pass them out, I send them through the mail. And I while the postage is exuberant, I enjoy every minute of bringing some sunshine into their lives.

My friend and i are wanting to get together with our church and our friends church to do an Operation Christmas for the town of Pearlington, Mississippi, and if you didnt know, Pearlington was only a couple of miles away from the eye of Hurricane Katrina. I did go down there in July to assist in Hurricane relief, coming home with a few new friends! So please if you could help and give me some ideas of gifts to give them, We would be forever grateful!! Reply:I just heard of a new thing...new to me anyway-it is called a bo-bo (long O) You take men's socks and make them. They are being made by kindergarten mothers in Florida for the children there. Any thing you can think of from a worm to the ever popular monkey. My niece is making a giraffe for her son. (cause that's what he asked for) I think there would be a variety of ideas - whatever the volunteers would come up with. Just to give the child something to hold on to and feel secure. Boys and girls both need that warmth and love that comes from holding something close.


If you have lots of money at your disposal and could buy stuff I would think the kids would all like those little scooter things. Like a skateboard with a tall handle/steering /balance control. They are pretty inexpensive. Good luck and God bless you right back!

First you need to think about what they probably have already to aviod giving them what they already have.


Clothing is good but things like bedding, I would assume they already have by now.


Other things like cudly toys, have probably been given as gifts already; other things like sweets and chocolate do not last and is invaluable.





I would think something that is useful, that they can keep that they wouldn't have had given to them.





I would suggest books of things they like; especally the younger children; then the mother can tell them bedtime stories.





Forget televisions, personal sterios and stuff; they probably can't afford the electricity to run anything like that.





Of course, cash would be a good one; but children could be irrisponsable with money; but thier parents not so much.

Gifts of money are never taxable to the person who receives them, no matter if it's 1 penny to all the money in the world. There is a form to fill out though for gifts received from a foreign person. I've attached the form %26amp; instructions (Form 3520) for you.





If the giver if a US citizen they can give $12,000 per year per person as a gift without any tax consequences. Above that amount they have to file a gift tax return, but have a $1,000,000 lifetime exclusion they can draw against for the excess.

Reply:I gave my son the book, "Love You Forever" by Robert Munsch. I wrote a special message in it for him to save when he's older. Reply:engraveable items, my son had his 1st in november of last year. we went insane on the gifts, but i think like a rocking horse or age appropriate toys (maybe a mini ball pit for the house! we got one of those as gifts, our son loves it. or maybe a piggy bank with his name engraved on it) will be great. also i had a BIG plastic "floor mat" underneath his high chair (for spills). after the party was over, i had each guest sign their name and write a short message to our little guy. I kept that in a box for him when he grows up!

Reply:Well, I think what you're doing is wonderful! I think maybe books would be nice... Maybe gift cards? Hmm... teens are so hard to buy for... I personally think journals make good gifts for people (maybe not the the burn victims) in those sorts of situations so they can work through their problems and whatnot... Even if you like baked a bunch of Christmas cookies, I'm sure it would be much appreciated. Maybe even things like basketballs or sports things for the kids who are into sports... But the burn victims will be hard to buy for. Even just writing them letters and giving them Christmas cards could do so much to brighten their day, you know? Or visit them in the hospital.





Perhaps talk to the people at CPS and find out about some of the teens like if they have special interests you can buy them something for. I don't know but I really admire you.

My aunt (who meets the IRS definition of being a non-resident alien) intends to give $50k towards my son's college education. My aunt lives in Switzerland. To ensure that the gift is given and received outside of the US (so as to make it non-taxable) I plan to open an account at a foreign bank into which I will receive the gift, and then wire to funds to the university. Gifts from non-resident aliens over $10k normally requires that the recipient file of IRS form 3250.





My Question: since this gift is being used for tuition, is it exempt from filing form 3250? IRC 6039F(b) (Notice of Large Gifts Received from Foreign Persons) has exepmtion language for tuition and medical expenses, but I find the language a bit vague.





Does someone know if, in the circumstances described above I am exempt from filing Form 3250? And thus, I can receive the gift tax free, spend it on tuition and file nothing with the IRS?

What are the reporting requirements on non-resident alien gifts?
I'm suspicious of the qualifications of the above "tax consultant" poster. I found the answer in the Form 3250 instructions on the IRS website, linked below, and it does NOT agree with what he states. I certainly won't be paying HIM for any advice any time soon!





You don't need to file the 3250 for a couple of reasons. One being the nature of the gift for tuition. The other is that the gift is coming from a foreign person where the reporting limit -- at least as I'm reading it -- is $100,000, not $12,760 (2006 rate, it's adjusted for the cost of living.)





Even if the gift had to be reported, it still would not be taxed. The 3250 filing simply advises the IRS of the transfer so that they can evaluate the taxable status of the transfer. A bona-fide gift is never taxable to the recipient.





Technically the donor would need to file a US Gift Tax return and pay any tax due, however as the donor is not subject to US taxation they cannot be compelled to so do. There might be a tax treaty that addresses that issue but that's a problem for the donor to contend with.





The US recipient of the gift is not taxed. Gift recipients are never taxed. It doesn't matter what the money is used for.





There is no need to set up a foreign account for this gift to pass through. In fact, doing so will significantly complicate matters as you will now have to file additional informational returns since you have authority over a foreign depository account.

It would be best to check with IRS directly(IRS.GOV) and even then get a letter from them not a e-mail or phone call.
